Terms of Service

1. Acceptance of Terms

By downloading, installing, or using "PDF Mail Engine" (the "Software") provided by OFFICE KAMIYA Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Software.

2. License Grant & Software Updates

Subject to your compliance with these Terms and payment of applicable fees, we grant you a perpetual, non-exclusive, non-transferable, limited license to install and use the specific version of the Software you purchased:

Starter License: On up to 1 device owned by you.
Professional License: On up to 3 devices owned by you.
Enterprise License: On up to 10 devices owned by you.

Important Note on Perpetual Licenses: Your license is perpetual for the specific major version purchased. Minor updates and bug fixes for that version are provided free of charge. Future major releases (e.g., upgrading from v1.x to v2.x) may require an upgrade fee. We reserve the right to discontinue support for older versions.

3. Restrictions & Prohibited Uses

You agree NOT to:

Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.
Rent, lease, lend, sell, redistribute, or sublicense the Software.
Use the Software to send unsolicited bulk email ("spam") or violate any applicable anti-spam or data protection laws (e.g., CAN-SPAM Act, GDPR, CCPA).
Use the Software for any illegal, fraudulent, or malicious purposes.

We reserve the right to immediately revoke your license key without a refund if we determine, in our sole discretion, that you have violated these restrictions.

4. Intellectual Property & User Data

The Software is protected by copyright laws and international treaties. We retain all ownership rights, title, and interest in the Software. However, you retain all rights to any documents (PDFs), data (CSV/Excel), and email content you process using the Software. We claim no ownership over your generated content.

5. Payments & Refunds

Our order process is conducted by our online reseller and Merchant of Record, Lemon Squeezy, LLC. By purchasing the Software, you also agree to Lemon Squeezy's Terms of Service. Refunds are governed strictly by our Refund Policy, outlined separately.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, SECURE, OR MEET YOUR SPECIFIC REQUIREMENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OFFICE KAMIYA INC. BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, LOSS OF BUSINESS PROFITS, OR FAILED EMAIL DELIVERIES) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Software shall be subject to the exclusive jurisdiction of the Shizuoka District Court in Shizuoka, Japan.
